Dr. McClellan, Accused of Insurance Fraud, Turns Himself In

A Crosby physician whose medical license was suspended last month turned himself in at the Harris County Jail Tuesday morning and then was released on $80,000 bail in connection with an insurance fraud charge.
Dr. David Mark McClellan, 53, was in New Mexico checking on his racehorses when authorities were seeking to arrest him last week, said McClellan’s attorney, Don Smith, of Baytown.
The charge is a third-degree felony punishable by up to 10 years in prison and a $10,000 fine. It stems from the Harris County fire marshal’s probe into five fires over 10 years involving three homes, a sports car and his office in which the doctor collected about $1 million, authorities said.
Rolex watches
While the fire investigations are continuing, Harris County investigator Dustin Deutsch said the fraud charge involves a pair of Rolex watches with a total value of $40,000. McClellan had signed a written claim that the watches had been lost when a fire gutted his residence in 2004.
However, Deutsch said McClellan knew the watches had been pawned by his ex-wife and another employee to fund a gambling trip.
Said Smith: “This investigation has been going on for a couple of years. I am not impressed that they ended up charging him over only these two watches. Dr. McClellan will come out unscathed.”
Meanwhile, Comal County’s deputy fire marshal, Wayne Ellington, said information about the deliberately set fire that burned McClellan’s vacation home in New Braunfels has been turned over to the U.S. Attorney’s Office for review.
House had flood damage
The house and contents, valued at about $200,000, burned in 2002 after being heavily damaged in a flood. McClellan had no flood insurance to cover the loss, authorities said.
Investigators say they have a taped conversation of McClellan offering a woman $600 to “forget” she had seen the doctor with a torch used in a first failed attempt to burn the house after the flood.
Two remodelers working at the vacation home have since been arrested and charged with arson in the case. They received a $2,500 check signed by the doctor, but he stopped payment on it, Deutsch said.
“McClellan says he had thought it was for repairs and claims to know nothing about the fire,” Deutsch said.
At the same time, John Rivas, who is representing McClellan in his fight to regain his medical license, said McClellan “is shocked and appalled by the charges (that caused the suspension).”
The suspension by the Texas Medical Board was based on allegations the doctor had inappropriate contact with female patients.
In addition, the order cited a historical pattern of such abuses dating back to 1993. These complaints resulted in his license being placed on probation in 1993 and 2004.
The doctor denied allegations made by eight women in 1994, but agreed to the probation to avoid further litigation, he said.

Are the molestation allegations true?
yes it is. i have seen him for years and know that he was is s.a. sex addicts annomous and he touched me, kissed me and one time he pulled out his penis
I think these molestation allegations are proposterous. As a matter of fact if Mark did react to any of these women it was because they initiated it. Dr. McClellan has been my doctor for 24 years and I am literally lost without him. My husband and I lived in Crosby for 18 years and I still drove from Alvin to see him. He saved my life when no other doctor could find out what was wrong with me. I am not vain but I know I am not ugly and he was never inappropriate with me sexually. I have always thought of him as a dear friend and still do.
If there is anything my husband or I can do someone please contact us as we both know him personally.
Who ever receives this email please email me with information of whom we can contact to share our positive knowledge instead of some of these bitter people (undoubtedly ones that were turned down for weight loss medication or whatever)and have an ax to grind.
To Whom it may concern, I agree with Vicki Champagne I want my Dr. back, he was never inappropriate with me sexually and although I’m not beautiful I’m not a bad looking lady and I’ve had several men flirting you might say and Dr. McCellan certainly wasn’t one of them. I don’t know him personally but I can tell you he is not the bad guy here. He is the only Dr. that I have been comfortable with in many years. I personally think the authorities are sweeping around the wrong back door.

dr mcclellan has been our family dr. for 20 years and has never done or said anything suggestive to anyone in our family. we have 4 girls and they are all very pretty and grandchildren also. he has always been a perfect gentleman around them. i think who ever did this is jealous and trying to ruin him and his family. their are quite a few people that do not believe a word of this. i know who is causing all of this and so does everyone else. what is the old saying. a womans scorn, I really miss our doctor and hope he returns, God Bless to Dr McClellan and his family. I refuse to believe any of these sexual allegations. Dr McClellan has always been very proffesional and respectful. I have several friends that have been his patients for years as well as me and my family. No one has ever said anything or insinuated anything or even seen anything wrong or innappropriate.
on my way to Kroger today i passed by a place on 2100 and Dr McClellan is opening up his practice. i don’t know when but it has his old telephone# up. Its near Talbots Phillip’s gas station next to the car wash. Just thought i would let everyone know. Just so happy our doctor is back. God Bless. The McDonalds.

Dr. McClellan is an excellent doctor. He’s always been very helpful to those without insurance and to the elderly. I know that for a fact, and I have no problem letting my daughter see him, or if she were to continue seeing him for the rest of her life. He’s a great man, and I’m honored to call him MY doctor, he’s been my doctor since I was 10 and will continue to be my doctor. Those who have hateful things to say, obviously have never been a patient of his, and know not of what they speak of. And maybe should shut their mouths, before talking out of their re ends.
i’v read everything on the Medical Boards website and i still don’t believe a word of it. Even though he is not able to have women as his patients yet, when he does i will continue to use him, and as a matter of fact, my husband will see him in his new office when he is ill. we both know Dr McClellan personaly and as his patients and i know someone was out to ruin him and his family, so they got someone to accuse him of these terrible things. He has helped a lot of elderly people in Barrett and Crosby with their medications they couldn’t afford, i know for a fact. my husband and i both have received our blood pressure samples and my husbands stroke medications. I’ve gone to Dr. McClellan since I was 2 and chubby, and now I am tall and spicy, with lucious full lips (Angelina Jolie) and he has yet to make a pass at me.
I too Have been a patient of Dr. McClellan. I never felt uncomfortable. He’s been our Dr. for almost 20 Years. He took very good care of my son as well. My son kept getting sick and his other Dr said they couldn’t find the problem, in 1 visit he found blood in his urine. Right away he sent him to Texas Children’s Hospital. I thank him for that. My son needed this care. He sincerly cares about his patients.
If you need a good witness I will be more than glad to stand up for this….

The doc is back! and everyone that is dumping on him should be ashamed. He is a wonderful doctor, and has helped my family greatly. My parents,brother,and nieces all go to the doc and he has never been touchy. Im glad he is back.

How dare you,especially the women.It is exactly these types of reactions why women do not report rape or abuse.And maybe you just were not his type or whatever the reason may be it is no reason not to believe the women it happened to.The Med.Board did not make him be chaperoned for no reason,they did not take away his ability to prescribe medicine with no reason.They look into these things quite seriously,I doubt you are more knowledgable about the situation than the TMB. I for one cannot believe he is allowed to walk the streets, much less be allowed to open another medical practice.Although I am seeing complaints as people are paying office charges only to be told he cannot prescribe anything, perhaps take 2 asprin ,sleep..and pay at the front desk. I can first hand say this man is a pervert along with 2 other members of my family.He nearly let my newborn die while as he had to take a crack break in the parking lot and displayed the most outrageous behavior I have seen in any human much less a Dr. All the nurses knew and were trying their best to take over,including having to deliver my baby as the good Dr. excused himself from the room as the baby was crowning…much more to this story but I will not go on with my own. As a woman however I would never EVER EVER make a woman feel shamed that she admitted to being sexually accosted, especially by a DR. with high priced attorneys who obviously have pulled a couple OJs for the man. He was accused of one million in insurance fraud only to have it brought down to fraudulently saying he burnt 2 rolexs when he knew they were pawned for a gambling trip. I do not doubt that he may have treated some families well, he had to have to stay for that long. But I know personally as do others what this monster is capable of. He will slip up again,that is the only thing that gives me some comfort and hope. His ego is wayyyy to big for hime not to think he can do whatever he likes and some high priced Atty, will get him out yet again. But I for one plan to continue to write the TMB complaints board and Ihope others will too, until he is so far down he cannot see the light of day. But there will be another he has to stand before someday ,much more powerful than man and I would not want to be in shoes then.He will have alot to pay for. To especially take advantage of the sick is even more disgusting. Wow! I was considering going to to him for weight loss help, but it looks like a situation that I don’t want to get myself into. It does seem strange that a totally innocent man would have so many allegations against them, however it could be said that he is just really, really down on his luck. Either way, I am 60 lbs over weight, have already lost 20, but can’t seem to lose anymore. I wish there was another doctor that I could consider going to for this sort of thing, and I’ve even still considering to McClellan’s office despite the allegations, especially if he can’t even see me. Oh well, I’m sorry to those who were molested, and I do agree that it is pretty stupid to assume those women are lying just because he never hit on you.
Dr McClellan has a new office in Liberty that is ran by another doctor for women and he has the diet plan. just call his office and they will give you the number.I do not know who this Garret woman is but she is really making up a lot of things about dr. McClellan I don’t think Dr.McClellan has ever delivered a baby. My husband has already started going back to him. we are really happy to have him back. This is why he lost his liscense to begin with, false accusations. Everyone that knows him does not believe a word of what was said. Good Luck Doc.
I did not know that the infamous Dr. McClellan ever delivered babies…ever. Hmmm, but if so I cant imagine going to him for that. When did he do that? I do however agree that it is amazing he is ‘allowed’ to practice medicine. He has over 20 pages stemming from around the early 90’s of sexual assault allegations, providing prescription narcotics to just about anyone who needed it. I myself have gone to him and he will literally prescribe ANYTHING you want, as long as you pay for the visit. There is a house he has in Crosby that has been on fire I believe the realtor said, 4x. Hmmmm, makes you think. He deserves his medical license to be revoked. If any of this is disputed, go to the Texas medical board web site, type in his name and see the pages and pages of his inquiries and ‘problems’. I cannot imagine trusting your HEALTH to such a person. Just an opinion but I would not take a rat to him, he does not deserve such a license.
I have noticed that the people who are making these accusations against Dr. McClellan they never put there name down, I think just to make up something they know nothing about. I know all about his house burning down and how. It caught on fire once,Some of the things these people write just make me want to laugh at them. they do not know what they are talking about. i don’t think they have ever gone to the dr. or even know him. He is a friend of ours and our Dr. also. I have always trusted him and continue to see him. Just as some of these people will continue to tell lies about him.
I was at a party with Mark McClellan when he joked about needing to get out from under the New Braunfels house and “maybe it will burn down”! Two weeks later it did. Explain that!
I do not know if any of the allegations against Dr. McClellan are true or not, but I do know that in the early 1980’s he was delivering babies. He delievered my neice, and was suppose to deliver my daughter in 1983, he was in the delivery room but had called in a gynocologists because my baby was in distress. He elivered many babies that I know of in the ’80’s and had many pregnant patients he took care of. I can say that his lack of attentiveness almost killed my sis in law and neice when she delivered. The rest of what I have heard is hear-say, so I will keep it to myself. But ….yes….he has delivered babies.
